Hey Clownfish (or anybody else involved with "Warren the Great Promiser").
The following reply was the last in a series of unfruitful e-mails between he and I, but he said we can take him to court if he again maintains his flakiness!
I don't think he'd even show up if we subpeoned him. Anyhow folks, eat it up.

Your e-mails have gone unrecognized because you are not a customer. Let me
explain. We have been working on resolving issues for the past few months.
All custom suit orders have been stopped We have not taken in any new
customers for some time now to avoid any issues until we are fully set up
state side to build the products here. We have put the web site under
construction to stop new inquiries. All other e-mails are being dropped
into the normal spam folder. Actual customer e-mails are being dropped into
a customer folder which is handled on a case by case basis. We have chosen
to work with customers as to when the order was taken first. This is the
only way we can take care of them because there isn't any new customers.
Currently we are working on collections from customers who have received
their suits and are behind in paying. These funds are then turned over to
other customers for their refunds.
All of our over sea equipment has been brought into the states. We have
received a large order which was set on a net 45day term the order has been
fulfilled and they have received the products today. No this was not
leather product but in any case there is more then enough funds to cover
anyone who is not taken care of by then. If you feel you must proceed with
legal litigation, then be my guest. If I was "possibly" purposefully and
willingly trying to commit fraud the easy legal way is to BK the company
and walk away debt free. We have chosen not to acknowledge any allegations
nor to respond with dates because of the past unfulfilled delivery dates.
Instead we are letting the roomers spread because there is nothing that we
can say or do at this time.
What I can say and you can take this to court....
I Warren Luciano owner of DVX RACING will honor all legitimate refunds owed
to all customers that have not received their products. By January 15th
2005 everyone will be refunded in full including a standard 8% interest
rate* from the initial delivery date. As well as provide the promised free
track day* either the month of April or May. Stephanie, Laura, and AKA
marmalade will be offered free suits* by the end of January with the
delivery of them within January. The track day will be open to all of DVX
customers.
If the above is not fulfilled you can take this to court!
*= all items with asterisk is only valid as long as this e-mail is
not made public to anyone other then current DVX customers that are
awaiting refund.
If any customers would like I can provide a post dated check to them.
funds should hit the account by the 12th but I am allowing a few extra days
for the wire transfer.

Interesting. I haven't received any correspondence from DVX. Perhaps my email gets dropped into the SPAM folder. I will withhold any comments until after January 15.

well by putting this letter in this forum or even showing it to an attorney or Judge, technically this letter does not mean shit!
That was good to Promise all this shit to people in a letter and then at the end weasel your way out of the exact same promise. Complete waste of time! This guy is a complete scam. You guys should report him to the BB. this guy should be banned from ever having a business again. Just my 2 cents

if you mean the Better Business Bureau... a bunch of us already tried that. i was completely disgusted with their response. something to the effect of....
well since this business was unreachable and/or would not return our attempts to contact them, we're closing our file
...complete and utter crap if u ask me. that organization is just as useless as Mr DVX himself.
oh, and while i'm not an attourney, i do believe that the mere fact that he took our money and promised goods in return, makes him a crook and therefore liable in a court of law

Whether I posted this or not, Warren has an obligation to provide service, or product for which he has recieved funds for.
It isn't my intention to smear Warren Luciano's name nor the name of his business. My interest is in making sure that anyone who has interest vested, or is looking to purchase products with his company, that they know what they're getting into.
I don't work for Warren, nor do I hold stock in his company, so whatever I have from him in writing is mine to do what I please with. Unfortunately for every body else not involved with this debaucle, you guys can't collect on his written promise. In the legal world, I believe that this could be possibly be used in the discovery act, or part of the disclosure mumbo jumbo.
If I'm wrong, I'll delete this post immediately to make sure I don't screw it up for anybody.

I was at that shop back in October. He gave me that same story about the shop made suits for his competitors and he sold his shares. He also said the moving of equipments back to the state. The new promised to me was my suit should be ready in about five weeks since he only has 5 suits to make.
I have called his shop and leave messages more than 4 times and emails him three times without any reply. I want my deposit back since it has been 7 months since he took my deposit.

wow, i joine the site about the time this all started. I went to z leathers instead. very happy with my suit.
1. i read the letter as saying " if you share this with anyone YOU will not get the items with * next to them.
2. Take him to court, pretty simple. small claims is cheap. once you recieve judgement you can have a marshall stand in his store and take possession of any money coming in. until the debt is paid.
file this week, and serve him at zorba's next tues. I'll serve him.

wow guys.. I still think its a bummer this whole thing happened. Seemed Warren had good intentions going in, but bit off way more than he could chew. The promise of crack-smoker's deals on leathers was all too appealing to some. I know I've been going to Z leathers for years, and have had good results.. I've also been thinking about giving Kelcy over at NJK a try.

I'm sorry to say folks that after attempting to reach Warren Via email, an automated response appeared in my mailbox stating that there was a delivery error. I don't know if that means he's closed up shop or what.
As you know, Warren made this bold promise to those waiting for refunds, that he'd not only make those refunds but add on 8% + some other crap, and would do all that by the 15th of this month. Well, as you shouldn't be surprised he fell through with that.
The day has come and gone, and I think that Warren will only respond to action-be it through the legal system, or some people knocking on the front door of his house.
I think it's time to pay him a visit.

I saw a guy in the WSMC new Racer's school this past weekend wearing a rare DVX suit. I gotta say man.. the suit wasn't that good looking.. The logo's looked to be placed wrong, and weren't really logo's, they were just block text. There's a few other new leathers coming out with very similar looking suits.. we call them "pakistanky" leathers because they're all made in Pakistan.. you can spot the pakistanky leathers from like a mile or more away ;)

Warren has not return call or email for over a month now. I know where he lives. Don't know the address off hand but I plan to ride over their to get the exact address and take him to court. He owns me $360 from the deposit 7 months ago. It is not that much money but I will go through the hassle to take him to court in Morenal Valley, his place of resident, for the principle.
Anyone knows he has a middle name?

Hey Hey there! I am one of the few owners of a super-uber RARE DVX suit and my suit looks great. Maybe his later models were Pakistankis...but his original lots were not bad at all. Hell, when I finally get back on 2 wheels you can judge then. My suit is perfect...custom lettering and custom fit to my rotund sexy body and all.

The person you saw was Lance, my husband. He thinks the suit is OK. We both ordered two piece suits in Jan 2004, and he made Lance's in a one piece by accident. He gave it to us and said we could have it, and he would still get us our two pieces. Neither of us has seen a suit since then. And yes, Warren is at Zorba's bike night every Tuesday. Although I haven't been there in a long time, I'm sure he hasn't stopped going.

yeah we even talked about it for a min or two.. you guys were pitted with my buddies "cobra racing" team.. You guys, like "Asian Image" are some of the "lucky ones".. Some people NEVER got their suits.. and probably never will. It sucks that so many people were burned by this guy... There are businesses that appear like DVX every now and then.. taking people's money and basically running..... Anyone remember TK-3 bodywork ;)
